A. INTRODUCTION

MCS generates notices for title II MCS clearance claims. This section explains how MCS creates a notice for an MCS clearance claim, who gets a notice, and how an FO/PC selects requested and dictated paragraphs for a notice. Additionally, it lists examples of each type of MCS notice and all FO/PC requested paragraphs.

Note: POMS NL 00725.001lists all system-generated paragraphs.

MCS does not produce a folder copy of the notice. MCS stores notice information in MCS Notice Display (NDIS). To see what information the notice contained, use function 25 (Notice Display) on the MCS menu. (See MSOM ORS 002.004 for further information on how to obtain and read the display. See

NL 00725.005.for a complete list of UTI's.)

 

B. HOW MCS CREATES NOTICES

MCS creates a notice for an MCS clearance claim after it processes the claim and establishes the MBR. Before MCS can create a notice, it gets information from the DADE screens and the MBR. It identifies the type of notice needed (award, disallowance, withdrawal, abatement or cover letter), chooses the notice heading and determines the language to be used in the notice (i.e. English and/or Spanish). When an MCS clearance claim requires notice information, select function 7 (Notice 3) on the Claims Clearance Menu (CMEN). This screen may be used for an MCS clearance claim when you need to request a paragraph, add dictated language, suppress a notice, or request an incomplete notice. MCS creates a notice if:

 

• Award Notice--DEC STAT on Decision Input (DECI) screen is 1, 4, 9, or 10 and the RDD field on the MBR is blank.

• Denial Notice--DEC STAT on Decision Input (DECI) screen is 3 and the RDD field on the MBR is 0A1, 0S1, 0X1 or 0X2.

• Disallowance Notice: DEC STAT on Decision Input (DECI) screen is 2 and the RDD field on the MBR is other than 200, 201 or 067.

• Withdrawal Notice: DEC STAT on Decision Input (DECI) screen is 7 and the RDD field on the MBR is 200 or 201.

• Abatement Notice: DEC STAT on Decision Input (DECI) screen is 7 and the RDD field on the MBR is 067.

MCS sends a message to WMS that the notice requires PC review if MCS finds an invalid combination of paragraphs and/or finds data on DADE screens that produced an incorrect notice. The PC reviews all system-generated notices and releases them unchanged or manually prepares and releases another notice.

MCS generates an alpha notice completion review indication that appears in the lower left-hand corner of the first page of the notice. The alpha review codes are:

• C = complete (no review needed) - disposition "mailroom"

• S = systems identified bad notice (review required) – disposition "CCRE"

• I = incomplete (review required) - disposition "CCRE"

• R = review (due to dictated language text UTI entered on the NOT 3 screen) - disposition "CCRE"

• Prepares a summary sheet (based on above)

• Prints the notice when requested

WHO GETS A NOTICE

MCS always sends a notice to a CL unless a legal representative has been appointed. Additionally, MCS sends a copy of the notice to an attorney, third party or representative payee.

When MCS sends a copy of the notice to a third party, a cover letter is sent with the notice.

When a hearing is requested and the result is an award notice, MCS will send a copy of the award notice with a cover letter to the ALJ.

MCS sends a Spanish cover letter with an English notice to a CL when MCS cannot generate a completely automated Spanish notice. This occurs when the FOs/PCs enter a requested or dictated UTI on the NOT 3 screen.

C. FO/PC Requested and Dictated Paragraphs

When a FO/PC wants to include special information in a notice, it types the special information on Notice 3 (NOT3) screen.

• A requested paragraph is a paragraph with standard language and FO/PC completed fill-ins.

Example:

This _____ benefit is the only benefit we can pay you at this time. We will let you know if you are eligible for ______ benefits. You cannot receive any other type of benefits based on the application you filed.

• A dictated paragraph is a blank paragraph that FO/PCs dictated complete to include specially tailored information in a paragraph notice.

Example:

A CR clears a claim that requires an earnings-dictated determination. Here is the paragraph he dictates:

“We cannot use your 1986 earnings from Worldwide Widget Company to compute your benefit because you did not distribute earnings to the other partners. All earnings were reported to your Social Security number. You can correct this by filing an amended tax return.”

D. HOW TO SELECT REQUESTED PARAGRAPHS

FO/PCs need to know when to request a paragraph for a notice. A Universal Text Identifier (UTI) is assigned to each requested paragraph. A requested UTI cannot be entered for abatements or withdrawals.

NOTE: We list the paragraphs in alphabetical and numerical order by UTI.

The chart below lists requested paragraphs (using the NOT3 screen) that require input of one or more manual fill-in's by the FO's and PC's in combination with automated fill-in's derived by MCS. The requested paragraphs that immediately follow do not have any manual fill-ins.

E. NOTICE FORMATS

Date Formats For FO/PC Requested Paragraph Fill-Ins

• MCS requires you to use a specific format for some FO/PC requested paragraph fill-ins.

YYYY Format

• Enter 4-digit dates in YYYY format for all year entries. Use only numbers. Do not abbreviate a year with an apostrophe.

Example: Paragraph BRRR13 requires you to fill in the current taxable year in YYYY format. The CL's current taxable year is 1989.

You type: 1989 Do not type: '89

Multiple Years

• You sometimes enter two (2) or three (3) years. When you enter more than one (1) year, type the entry exactly as shown below. Include "and", commas, and spaces.

Example: 2 years  YYYY and YYYY  3 years YYYY, YYYY, and YYYY

Example: Paragraph SEIR02 allows you to fill in multiple years for income excluded from the computation. You exclude earnings for 1986 through 1988.

You enter: 1986, 1987, and 1988

Month YYYY

• Enter month and year entries in Month YYYY format. Spell out the full month name and type the 4-digit year. Do not use numbers for months.

Example: Paragraph MSVR06 requires you to fill in the month(s) and year(s) of active military service you are developing. You are developing military service from January 1951 through December 1956.

You enter: January 1951 through December 1956 Do not type: 01/1951 - 12/1956 or 0151 through 1256

Money Formats For FO/PC Requested Paragraph Fill-Ins

• You type most money amounts for FO/PC requested paragraph fill-ins in standard $$$$$.cc format.

• The $$$$$.cc format requires you to type money amounts using eight (8) characters. One character must be a decimal point. Use $$$$$.cc format for the fill-in information in the requested paragraphs that follow. MCS does not allow:

• Dollar Signs

• Commas

• Use this procedure to type money amounts in $$$$$.cc format for requested paragraphs.

• Enter the dollar amount in five (5) digits if the fill-in tells you to use $$$$$.cc format for this money amount. Use lead zeros if needed.

• Reminder: Do not type a dollar sign ($) or comma.

• Type a decimal point.

• Enter the actual cents amount. Use two (2) digits. Enter 00 if the money amount does not include cents.

Example 1:

Fill-in two (2) in paragraph ERNR15 requires you to type the corrected wage amount in $$$$$.cc format. The CL's corrected wage amount is $9,286.50.

You enter: 09286.50

Result: MCS prints $9,286.50 on the notice.

Example 2:

Fill-in two (2) in paragraph ERNR15 requires you to type the corrected wage amount in $$$$$.cc format. The CL's corrected wage amount is $15,872.00.

You enter: 15872.00

Result: MCS prints $15,872 on the notice.

When a requested paragraph includes a "free format type" fill-in that involves a money amount, you cannot follow the $$$$$.cc format rule because MCS prints the typed information, exactly as you typed it.

Example: "0" place setter(s), etc.

Fill-in one (1) in paragraph ERNR14 lets you input the reason for earnings record change in a free format.

You enter this information: We have discovered that your posted earnings of $12,234 for 1989 belonged to your brother and cannot be considered your income.

Result: MCS prints the text exactly as shown on the notice.

• Note:  Use the procedure in "Money Amount Formats For Dictated Paragraphs" at the end of this section that explains how to type money amounts in "Dictated Paragraphs".

Format For FO/PC Requested Paragraph Fill-Ins Involving Specific Words

• MCS requires you to use a specific format for some FO/PC requested paragraph fill-ins. MCS sometimes requires you to choose specific words or characters as the whole or part of a fill-in entry. MSOM shows these entries in quotation marks:

• (" ").

Enter the fill-in you want exactly as shown in the quotation marks.

Example: You determine that a grandchild relationship has been established, but the child did not meet the dependency requirement before the number holder died. You use paragraph DEPR09 to explain why benefits will not be payable.

DEPR09 Reads:

To qualify for child's benefits as a dependent grandchild or step grandchild on (number holder’s given name and number holder’s last name) Social Security record, (beneficiary's given name and beneficiary's last name) must have:

• Begun living with (him) or (her) before age 18; and

• Lived with Mr. (number holder’s last name) or Ms. (number holder’s last name) in the United States and received one-half support from (him) or (her) throughout the year before (he) or (she) (1).

• MSOM shows the fill-in choices as:

- "Became entitled to retirement benefits", or

- "Became entitled to disability benefits", or

- "Became disabled", or

- "Died".

G. HOW TO SELECT DICTATED PARAGRAPHS

An FO/PC dictates language for a notice when requested paragraphs do not fully cover the situation. MCS arranges paragraphs in a notice under captions, in a pre-determined order, according to the Universal Text Identifier (UTI). You must choose the correct UTI for dictated language so that MCS will put it in the proper place on the notice. The captions shown below are automatically generated whenever the corresponding UTI for dictated language is entered on the NOT3 screen.

This procedure tells you which UTI to request when you need to dictate a paragraph for an MCS-clearance claim notice.

Caution: You cannot enter a dictated UTI for abatements and withdrawal notices.

H. DATE FORMATS FOR DICTATED PARAGRAPHS

SSA's notice standards require specific formats for all dates. You must use these formats when typing dictated paragraphs on Notice 3 (NOT3) so that MCS will print the notice correctly.

YYYY format

Type years in YYYY format. Always use four (4) digits. Do not abbreviate a year with an apostrophe.

Example: You are referring to an event in 1989.

• You type: 1989 Do not type: '89

Month YYYY Format

Type month and year entries in Month YYYY format. Spell out the full month name and type the four (4)-digit year. Do not use numbers for months.

Example: You are referring to May 1989.

• You type: MAY 1989 Do not type: 05 1989 or 5/89

I. MONEY AMOUNT FORMATS FOR DICTATED PARAGRAPHS

SSA's notice standards require a specific format for all money amounts. Unlike the $$$$$.cc money amount format for requested paragraph fill-ins, MCS does not format the money amounts in dictated paragraphs and some requested paragraph fill-ins when it prints the notice. MCS prints the money amounts exactly as you type them.

Use the following procedure to type/enter in money amounts:

• Dictated paragraphs.

• Requested paragraph fill-ins that do not specify the $$$$$.cc format.

Type:
