HA 01170.008 Jurisdiction for Review of Class Claim Cases

If a court order requires readjudication of class claims, class claims involving the issue of disability are usually under the jurisdiction of the DDS which made the determination to be reviewed.

EXCEPTIONS: 

A court order or settlement agreement may specify a certain level of review, i.e., the administrative level at which the readjudication of class member claims will take place, or the issue involved may be appropriate for review only at a particular level.

See HA 01170.015 concerning jurisdiction questions. OHA may assume jurisdiction in certain instances, e.g., when class member claims and subsequent (current) claims are consolidated at the OHA level (see HA 01170.013).
