HA 01205.010 Initial Actions on Receipt of Case

After a hearing office (HO) receives a case and establishes a record in the Case Processing and Management System (see Hearings, Appeals and Litigation Law (HALLEX) manual HA 01205.001), designated HO staff will:

  • Ensure the request for hearing (RH) is associated with the record;

  • Evaluate whether the case is within the HO's jurisdiction (see HALLEX HA 01205.070);

  • Determine if the RH is a valid request and was timely filed (see HALLEX HA 01205.040);

  • Evaluate whether one of the special situations for expedited processing apply (see HALLEX HA 01210.055 D);

  • Acknowledge receipt of the RH (see HALLEX HA 01205.020); and

  • When applicable, request a paper claim(s) file if it was not received with the RH (see HALLEX HA 01210.010).
