RS 00208.045 Mothers and Fathers Proof of Age

A. Policy for proof of age

1. General policy on proof of age

Proof of age usually is not required to establish entitlement to a mother's/father's benefit.

2. Exception to the general policy on proof of age

The claimant age 50 or over must provide proof of age for entitlement to Medicare as a deemed disabled widow(er) benefit (DWB). For requirements for a claimant seeking HI based on deemed DWB entitlement, see RS 00208.110B

3. When and why to request proof of age

  1. a. 

    The claimant's proof of age is required when the NH is fully insured and either:

    • The claimant has a disabled child-in-care, or

    • The claimant will be full retirement age (FRA) before the youngest child is age 16.

    NOTE: If the youngest entitled child will attain age 16 after the mother/father has attained age 60 but before full retirement age (FRA), do not request proof of age but instead obtain it when she or he files for widow’s or widower’s insurance benefits (WIB).

  2. b. 

    Proof of age is necessary to:

    • permit conversion to WIB at FRA;

    • prevent deductions when the entitled child is not in-care.

B. FO procedures for requesting proof of age

Do not unduly delay a claim awaiting development of proof of age, instead

  1. 1. 

    Request proof of age when required, see RS 00208.045A.3.a.;

  2. 2. 

    Document the request for proof of age;

  3. 3. 

    Make the award;

  4. 4. 

    Send the case to the processing center (PC);

  5. 5. 

    Send the evidence of age to the PC after receiving it.

C. PC procedures to establish date of birth

Establish the date of birth based upon the evidence received and annotate the appropriate code to the MBR.
