Beginning 1/1/40, service performed as a student nurse in the employ of a hospital or nurses' training school is not covered if:

  the student nurse is enrolled and regularly attending classes in a nurses' training school; and

• •

  the nurses' training school is chartered or approved under State law.

There is no specific exclusion for years before 1940.

The intent of Congress is to exclude student nurse employment:

• •

  that is part-time;

• •

  when the only service performed is incidental to the student's training; and

• •

  when the remuneration for services is nominal.
