RS 00301.106 Deemed Fully Insured

A. Policy for deemed fully insured

1. Applicability

Any number holder (NH) who on 01/01/84 is:

  • •

    age 55 or older; and

  • •

    an employee of a nonprofit (non-covered) employer which does not have in effect on 01/01/84 a waiver certification (under section 312(k) of the Internal Revenue Code); and

  • •

    is extended coverage effective 01/01/84, solely because of the 1983 amendments, that they can be deemed to be fully insured with fewer quarters of coverage (QC) than are ordinarily required, if they are earned after 1983.

2. Exceptions

The deemed fully insured provision does not apply to a NH who declined coverage even though a waiver certificate was in effect on 01/01/84.

This provision does not apply to members of a religious order who have taken a vow-of-poverty.

B. Related policy for deemed fully insured

Age 55 or over but less than age 57 (DB 01/03/27 through 01/02/29)

2. Earliest effective month 01/01/84

A NH is deemed fully insured for all title II purposes if they meet the deemed fully insured test.

EXAMPLE: NH's coverage begins 01/01/84. The first month the NH meets deemed insured status for Retirement Survivors Insurance benefits is 04/01/85. The first day of the first month of a qualifying quarter.

3. QCs earned before 01/01/84

Do not use QCs earned before 01/01/84 for deemed fully insured status. Use QCs earned before 01/01/84 in addition to the QCs earned after 1983 to establish regular fully insured status.

4. NH works for different employer

The only requirements for deemed fully insured status are the age and employment qualifications as outlined in RS 00301.106A in this section. If a NH meets the requirements in RS 00301.106A in this section as of 01/01/84, and they take another position with a different employer after 01/01/84 and earns additional QCs, use these QCs to establish deemed fully insured status.
