GN 04020.070 Unrestricted Reopening - Determinations or Decisions With Respect to Insured Status — Policy Principle

A claim disallowed or denied for lack of insured status may be reopened at any time where earnings which would have given the NH insured status if credited at the time of the determination or decision, are later credited to the NH's E /R to:

Correct errors apparent on the face of the earnings record; or

Enter items transferred by RRB which were credited under the RRA when they should have been credited under the Social Security Act;

Correct errors made in the allocation of wages or SEI to individuals or periods.

The wage or SEI reporting or other evidence of such earnings must have been received by SSA or RRB before the date of the notice of the disallowance or denial.(See GN 04001.070 for exception.)

If after reviewing the Earnings Record, it's not apparent whether SSA or RRB had these earnings in possession at the time of the disallowance or denial notice, it should be assumed in favor of the beneficiary that SSA or RRB did have these earnings in possession at the time of the disallowance or denial determination.
