RS 00208.095 Field Office (FO) Action When Notice of Death Received from Widow(er) Entitled as Spouse under Full Retirement Age (FRA) with Child-in-Care

A. Procedure for claimant under full retirement age (FRA) entitled to spouse’s benefit based on child-in-care

When a claimant is under FRA with a child-in-care entitled to spouse's benefits, and the FO receives notice of the NH's death from a source other than the processing center (PC), take the following action:

1. Notifying the PC

Whenever applicable, process the notice by direct input or notify the PC by mail.

2. Additional development requirements

Include the following additional development as necessary:

  1. a. 

    additional wages or self-employment income (SEI) for a survivors work recomputation;

  2. b. 

    proof of LISH for a deemed widow(er) where necessary, see RS 00208.090D;

  3. c. 

    an annual report;

  4. d. 

    substitution of representative payee; and

  5. e. 

    proof of “child-in-care,” (not required if spouse was payee for the child, unless we suspended the spouse's benefits for the month of the NH's death for failure to have a child-in-care).

B. Procedure for underpayment and overpayment

Tell the widow(er) that we adjust any future Social Security benefits against an overpayment or underpayment. See GN 02201.003.
