This section applies on all claims when the initial month of entitlement on the current
claim is January 2000 or later. The existence of a prior claim with entitlement before
2000 is immaterial.
The DIB PIA is recomputed based on deemed age 62 in the first full month of the waiting
period. The freeze period does not end until the NH attains deemed full retirement
age (FRA). Any base years wholly within this period cannot be used unless the entire
freeze period is disregarded for purposes of a DIB non-freeze recomputation. NOTE: FRA may be any age from 65 – 67 depending on the date of birth. See RS 00615.003 for FRA information.
Example:
A person born in 1962 has a disability onset of 12/15/1999. The first month of the
waiting period (deemed age 62) is 1/2000. FRA for a person born in 1962 is 67. If
the NH is deemed to be age 62 in 1/2000 then deemed age 67 (FRA) would occur in 1/2005.
Years from 2000 through 2004 cannot be used in a disability exclusion computation
because they are wholly within the period of disability.
