The agreement establishes the following general rule for government employees:

U.S. national employed by the U.S. Government in Germany—U.S. coverage applies (Social
Security and/or Federal Pension Program)

German national employed by the German Government in the United States—German coverage
applies
In addition to this general rule, the agreement also includes provisions that govern
the coverage of persons employed by government employees, but these provisions have
limited applicability.
NOTE: For purposes of applying this provision of the agreement, the term U.S. Government
employee includes employees of the Federal Government or any of its instrumentalities.
