California pays OSS E to a disabled (not blind) child under age 18 who resides with
a parent or relative by blood or marriage (until September 30, 1979, a disabled child
under age 18 living with a legal guardian also fell into this category).
NOTE: Effective February 1, 1982, only FLA A and C are compatible with OSS E. If the VTR
applies, see OSS G SI SF01415.160B.
Examples:
-
1.
Maria Able, a 15 year-old disabled child, attends a residential school for the deaf
and returns to Maria's parent's home on weekends, holidays and in the summer. Maria
is determined to be residing in Maria's parent's household. Therefore, Maria's FLA
is C and OSS E applies.
-
2.
Beatrice Charles, a 10 year-old disabled child, lives alone with a relative. Beatrice
pays Beatrice's pro-rata share of the food and shelter expenses. Therefore, Beatrice's
FLA is A and OSS E applies.
