The Social Security Act (Act) provides that a period of disability and disability
benefits terminate at the end of the second month after the month in which the beneficiary
is no longer disabled. The Act also precludes a re-entitled claimant from receiving
benefits for overlapping periods of disability.

EXAMPLE: Disability ceased on 4/30/89 for medical improvement, and benefits terminated on
6/30/89. The claimant filed a new application on 6/19/89 alleging a new impairment.
The Disability Determination Services (DDS) determined that the claimant was disabled
as of 5/30/89; however, based on the claimant’s prior period of entitlement, the onset
was established effective 07/01/89, which is the first day after the day benefits
            terminated.
