DI 26525.005 Diaries in Multiple Entitlement Situations

A. Policy

Generally, use the same medical diary for multiple entitlement. (See exception in DI 26525.005B.1. for title XVI statutory blindness cases.)

NOTE: A later claim does not in itself raise a CDR issue on the existing entitlement, even when there is an expired diary (i.e., collateral estoppel). See DI 27515.000 for adoption policy.

B. Procedure

1. Simultaneous or Concurrent Claims

a. Medical Diary

Set the same medical diary in simultaneous and concurrent claims.

b. Exceptions

Set a MIE diary in title XVI blindness cases to mature up to age 64 1/2 when the individual is expected to no longer meet the title XVI statutory blindness requirement.

2. Existing Entitlement and New Claim

Follow adoption instructions in DI 27515.000 for existing entitlement and new claims.

When a medical improvement issue is currently raised, immediately initiate a CDR on the existing entitlement. (See DI 28001.015)

When a medical improvement issue is not raised, set whatever diary is appropriate on the new claim following the guidelines in DI 26525.00ff.
