GN 00306.015 Presumption of Legitimacy and Lord Mansfield Rule

POLICY

Two rules exist under State law to protect the legitimate status of children born during wedlock. SSA must follow those rules in determining the status of such a child under State law. The rules are:

  • The presumption of legitimacy, which applies in all States. (See GN 00306.020 -
    GN 00306.021.)

  • The Lord Mansfield Rule, which applies only in certain States. (See GN 00306.025.)
