GN 01703.255 Totalization Claims Filed by RSDI Beneficiaries

A. Policy

The United States will not consider foreign coverage if a NH is fully insured based on U.S. coverage only unless foreign coverage might yield either an earlier MOEN or DIB insured status. These claims are often received as unrestricted claims from the foreign agencies.

B. Procedure

Proceed as follows when a totalization claim is filed by an RSDI beneficiary.

1. Earlier MOEN or DIB insured status possible

  1. a. 

    If there is a possibility that foreign coverage could yield either an earlier MOEN or DIB insured status, obtain foreign coverage certification. (See GN 01703.200.B.2. - regarding filing dates provided by foreign agencies.)

  2. b. 

    Disallow the totalization application if foreign coverage does not result in an earlier MOEN or DIB insured status.

  3. c. 

    Prepare an amended award for totalization benefits, if foreign coverage yields a more advantageous MOEN.

  4. d. 

    Develop for necessary medical applications and evidence if DIB insured status is met. When all is returned, forward medical jacket to DRDD.

2. Earlier MOEN or DIB insured status not possible

Disallow the claim if an earlier MOEN or DIB insured status is not possible. (See GN 01703.310 for instructions on how to disallow totalization claims and NL 00711.310.F for appropriate paragraphs.)
