GN 01722.010 How to Develop and Process Applications Filed in the Foreign Service Post (FSP)

A. Introduction

The FSP in Madrid takes claims from individuals who wish to file for benefits under the Spanish agreement and also assists in processing certain types of claims filed with a Spanish agency. When taking applications under the agreement, the FSP follows the same general procedures and obtains the same applications and evidence as SSA field offices. (See GN 01702.001 - GN 01702.525 for DO and FSP Development and GN 01721.205 - GN 01721.215 for Evidence and Application Requirements.)

B. Procedure

Follow these steps for developing and processing applications.

1. U.S. Claim

  • Obtain form SSA-2490-F4 (Part 1), Form E/USA 2 and the appropriate RSDI applications.

  • Forward a liaison form SSA-2960-U3-SP and form E/USA 2 to the Instituto Social de la Marina (ISM) or to the Instituto Nacional de Seguridad Social (INSS) to request a Spanish coverage record.

    (See GN 01722.045 for determining which Spanish agency office has jurisdiction of the claim).

    Attach a copy of the worker's Spanish Navigation Book (If the worker was employed at sea), and a copy of the applicant's DNI (National Identity Card).

  • Forward the claim to OIO with the file copy of the liaison form sent to the Spanish agency.

2. Spanish Claim

Advise the applicant to file a Spanish claim at the local or central office of the ISM or at the appropriate provincial office of the INSS.

3. U.S. and Spanish Claim

  • Obtain form SSA-2490-F4 (Parts I and II) and the appropriate RSDI application.

  • Forward a liaison form SSA-2960-U3-SP to the ISM or to the appropriate provincial office of the INSS to certify the date of filing and to request a Spanish coverage record.

  • Forward the claim to OIO with the file copy of the liaison form sent to the Spanish agency.

  • Advise the applicant to file a Spanish claim at the local or central office of the ISM or at the appropriate provincial office of the INSS.
