GN 01722.012 How the Foreign Service Post Processes and Develops Claims Filed With a Spanish Agency

A. Process

When a claimant contacts a Spanish agency office to file a claim for U.S. benefits, the claimant completes form E/USA 2 (Statement of Intent to File for U.S. Benefits). The Spanish Agency then forwards the form to the FSP, Madrid.

B. Procedure

Use the following procedure for developing the claim.

1. Claimant is not already entitled

If the claimant is not already entitled to U.S. benefits, obtain a statement that the claimant does not want to file, or develop as follows:

  • Obtain the appropriate RSDI applications.

  • Obtain form SSA-2490 (Part I) if the claimant will not be insured with U.S. coverage.

After development, forward the statement or claim to OIO.

2. Claimant is already entitled

If the claimant is already entitled to U.S. benefits, forward form E/USA 2 to OIO. Request OIO to close out the protective filing.
