GN 01722.025 Spanish Liaison Agencies

A. Introduction

There are two liaison agencies in Spain that are responsible for implementing the Spanish agreement. The Instituto Social de la Marina (ISM) has jurisdiction of the earnings records and claims of Maritime Workers. The Instituto Nacional de la Seguridad Social (INSS) has jurisdiction of claims filed by all other workers.

The INSS and ISM both have central offices in Madrid and local offices in the Spanish provinces.

C. Process

The following subsection describes how the Spanish agencies determine which office has jurisdiction of a claim.

1. Maritime Workers

Claims filed by maritime workers are processed by the central office of the ISM. If a claimant files an application in one of the local ISM offices, the claim is forwarded to the central office in Madrid where the processing is completed.

2. All Other Workers

Claims filed by all other workers are processed by the appropriate provincial office of the INSS.

  • If the claimant resides in Spain, the claim is processed by the provincial office in the province where the claimant resides.

  • If the claimant resides outside Spain, the INSS central office determines which provincial office has jurisdiction of a claim. When OIO sends a claim to the central office, that office routes it to the correct provincial office and sends a referral letter to SSA. Refer to GN 01722.035 for a sample of the referral letter in Spanish and in English.
