GN 01734.320 How OIO Processes Luxembourg Agency Requests for Special Evidence

A. Introduction

As explained in GN 01733.130, Luxembourg has recent coverage requirements for the payment of disability or survivors benefits. The worker must have made contributions for at least 12 months during the three years before the onset of disability or the date of death. The 3 year period may be extended for periods of education, child-rearing and prior periods of disability.

B. Process

Luxembourg may ask OIO for evidence to verify these periods that have occurred while the worker was in the United States.

When the Luxembourg agencies need verification of periods of education, child-rearing and prior periods of disability, they request specific information in the “Remarks” section of form LUX/USA 3. For example, when the agencies want to establish periods of child-rearing, they request the birth certificates of the children.

C. Procedure

Use the following procedure for responding to Luxembourg agency requests for special evidence:

 

If the Luxembourg agency requests OIO to verify periods of... then...

education

  • request the claimant to submit a statement signed by a school official that verifies dates of attendance; and

  • forward the statement to the requesting agency with the liaison form SSA-2960-U3 LX.

child-rearing

  • request the claimant to submit original or certified photocopies of the birth certificates of the children (if they are not already in OIO files); and

  • forward the documents to the requesting agency with the liaison form SSA-2960-U3 LX.

prior periods of

disability

  • check the MBR to determine if the claimant has been entitled to disability benefits; and

  • complete the appropriate item in Section II.B. on the liaison form SSA-2960-U3-LX. Refer to the instructions in GN 01734.220C. for completing the form.
