GN 01752.010 How to Develop and Process Applications Filed in the Foreign Service Post in Warsaw, Poland

A. Introduction – Warsaw Foreign Service Post

The Warsaw Foreign Service Post (FSP) takes claims from individuals residing in Poland who wish to file for U.S. benefits.

When processing claims under the agreement, the FSP should follow the same general procedures and obtain the same applications and evidence as SSA field offices.

B. Procedure – special development and routing for claims filed in Warsaw

This procedure describes special development and routing instructions that apply to claims under the agreement filed in Warsaw, Poland.

1. U.S. Claim

a. Retirement, Survivors, and Disability Claims

The Foreign Benefits Unit (FBU) in Warsaw will contact the applicant and obtain form SSA-2490BK and any appropriate U.S. applications. Warsaw FBU will forward a liaison Form SSA-e2960 (U3–PL) and Part I and II of Form SSA-2490 to ZUS or KRUS, to request a coverage record.

For retirement and disability claims, complete the appropriate MCS application screens and the TOTALIZATION (TOTL) Screen (see, MSOM MCS 009.011) and SSA-2490 screens (MSOM MCS 007.001).

b. Survivor Claims under the Polish agreement

For survivor claims, complete the appropriate MCS application screens, the Totalization (TOTL) screen (see MSOM MCS 009.011) and Part 1 of the paper or electronic (e-form) application Form SSA-2490-BK.

c. Worker Appears Not to be Insured Based On U.S. Coverage Alone- Requesting Polish Coverage Record

Forward a liaison form SSA-e2960 –U3–PL), to ZUS or KRUS to request the Polish certified coverage record if it appears that the worker is not insured based on U.S. coverage alone.

d. Claim to OIO for processing

Forward the claim to DIO and include a copy of the completed liaison form sent to ZUS or KRUS.

C. Polish Claim

Any inquiries for Polish benefits from a resident of the Republic of Poland received in the FSP in Warsaw, Poland will be referred to either ZUS or KRUS.

If ZUS or KRUS needs U.S. certified earnings record and/or entitlement information to process a claim for Polish benefits, it will request the information directly from the FSP in Warsaw, Poland using a liaison form SSA-e2960-U3-PL.
