GN 02607.870 Processing a Resumption Action for an Incorrect Title II Benefit Suspension

A. PROCEDURE – FO PROCESSING RESUMPTION OF AN INCORRECT BENEFIT SUSPENSION

1. FO Instructions for Resuming Benefits for an Incorrect Prisoner/NGRI Suspension

In some circumstances, we incorrectly suspend an individual's benefits because of misidentification of the incarcerated individual or misinformation about the confinement period. When we discover the error and must resume the benefits to the suspended individual, take the following actions.

  • Reinstate benefits via the POS, Prisoner Suspensions and Reinstatement (PRSN) screen by selecting option 5 of the Post Entitlement Selection List (PESL) and option Prisoner Suspensions and Reinstatements (LAF-S7) on the PEST screen.

  • If PUPS is present, PRSN automatically mini-paths to PUPS. Update the PU02 with the RELEASED DATE. (TYPE OF ACTION of 5 for REINSTATEMENT is pre-filled.)

    NOTE: Post a RELEASED DATE equal to the DATE OF CONFINEMENT that is currently on the PUPS record.

  • Press ENTER on PU02, you will return to the POS, PRSN screen. Complete any overpayment fields that are present. (See MSOM COMMON 005.027 for additional information when you have an existing BOUD or Partial Recovery Field on the MBR for the beneficiary.) Press ENTER to finally trigger the reinstatement action. You will receive a message indicating whether a POS processing exclusion exists on your action or if the case processed.

  • Explain on the REMARKS screen that the case is an erroneous suspension and briefly state the circumstances of the case and why we need to reinstate the benefits.

2. Effective Date for the Resumption of Benefits

The resumption action begins benefits effective with the month of suspension.

B. PROCEDURE – PC/OCO-ODO INSTRUCTIONS FOR RESUMING BENEFITS AFTER INCORRECT SUSPENSIONS

1. PC/OCO-ODO Instructions for Resuming Benefits after an Incorrect Prisoner/NGRI Suspension
