GN 03340.045 Pledges of Confidentiality - Policy

SSA generally should not pledge confidentiality of information because SSA cannot deny access by an individual to information obtained from third parties that is part of that individual's claims folder, or of medical records identified as “confidential.”

However, a pledge of confidentiality may be made to protect third party statements in an investigative or program integrity file, as described in GN 03340.050. Such files are exempt from access by the individual to whom the statements pertain and are not part of the claims folder system of records.
