RS 00615.654 Special Situations Involving Payment of the MSSR

POLICY

1. Technical Entitlement

A child who is entitled on more than one Social Security number (SSN) can receive benefits only on one SSN. The technical entitlement on the other SSN will not prevent the payment of the MSSR to another beneficiary entitled only on that account.

2. Child Entitlement Under Section 216(h)(3)

When two children are entitled and one is entitled under 216(h)(3), MSSR can be paid only if the child who was not entitled under 216(h)(3) is protected by the special savings clause established under the 1967 amendment.

3. Parent Suspended For No Child In Care, Prisoner Suspension, or DAA Suspension

When a parent is suspended, the only child on the record is not entitled to the MSSR.
