RS 00615.680 Divorced Spouse or Surviving Divorced Spouse Entitlement Disregarded for Family Maximum and Minimum Benefit Purposes

A. POLICY

The benefit of a divorced spouse or surviving divorced spouse (B6/BR, D6/DC or W6/WR) is not subject to reduction for the maximum.

B. PROCEDURE

1. MSSR is Payable

  • If MSSR is payable and a D6/DC or W6/WR and one other survivor are entitled pay the MSSR to the survivor but do not pay the MSSR to the D6/DC or W6/WR.

  • If MSSR is payable and the D6/DC or W6/WR is the only survivor entitled pay the MSSR to the D6/DC or W6/WR.

  • If MSSR is payable and more than one divorced spouse/surviving divorced spouse are entitled pay the MSSR to each.

2. MSSR is not Payable

Adjust the rates of all survivors for the maximum without considering the divorced spouse/surviving divorced spouse.
