RS 01404.240 Reopening Claim - OPM Use/Nonuse of Internment Credits

A. POLICY

There is unrestricted reopening regarding the use or non-use of deemed wages for internment by OPM. See GN 04020.100.

B. PROCESS

1. General

OPM notifies SSA of its use or non-use of deemed wages for internment. Then, SSA reviewing office checks file to see if SSA used deemed wages for same period. The reviewing office takes any necessary action and issues any necessary notices.

2. Recalculation

Possibility of internment credits is brought to SSA's attention. SSA reviewing office develops per RS 01404.235.

Not used by SSA OPM non-use Develop per RS 01404.235, except for RS 01404.235C.5.

Used by SSA

OPM uses

  • Resolve discrepancy if a claimant's statement alleges non-use;

  • If removing deemed wages, prepare redetermination if insured status is lost or if PIA is recalculated;

    NOTE: Effective date for either is first month in which benefit IS PAID By Federal agency.

  • Recoup any overpayment per GN 02201.000 ff.

Used by SSA OPM non-use Discontinue development.
