RS 02201.035 When Prior Earnings Determination is Not Reflected on an E/R

A. POLICY PRINCIPLE

When an initial determination (see GN 03101.040) has been made concerning an E /R, and such determination has become final (see GN 04001.040), the amount of earnings established by the determination is the amount of SSA's records. The fact that, for whatever reason, this amount does not physically appear on the E/R maintained by OCRO is immaterial.

B. OPERATING POLICY

When an E/R determination is made, such determination constructively adds wages or SEI or deletes wages or SEI from an individual's E/R effective with the date of the notice of the initial determination.

After the initial determination becomes final, it may be reopened only under the conditions outlined in GN 04020.010 ff.

C. PROCEDURE

If a prior earnings determination is not shown on OCRO's records, take action to reflect the determination. Even if the time limitation has expired, the NH's record may be corrected to conform to a prior determination.
