DI 40505.200 Applicability of CDR Events and CDR Results on Both Titles

A. Policy principle - general rule

Events which may raise a CDR issue are generally the samefor title XVI and title II.

B. Policy principle - work issue exception

1. No SGA cessations under Title XVI

Effective 7/1/87, under title XVI, section 1619, SGA is not a reason for disability cessation, and the TWP and EPE do not apply. Earnings are treated as income and resources - SI 02302.001.

2. Medical CDR may be required

1619 eligibles must have disabling impairments, so medical folder reviews (MFRs) and some CDRs are required - DI 40540.001.

C. Operating policy

Medical CDR or MFR results apply on both titles, if the disability issue is the same- see DI 28005.001 on CDR evaluation. For example, if a 1619 CDR results in a medical cessation, a title II cessation determination is also needed, even if the TWP has not ended. (However, if title II benefits cease due to SGA, or if the disability issues are different, title XVI eligibility may continue.)

Likewise, if no issue is found during an MFR, SSA-899-U2s are needed on both titles.
