DI 41005.015 Work Issue CDR: All Statutorily Blind Individuals Except DIB, CDB, and DWB Persons Age 55 or Older

A. General

The TWP and EPE provisions of the law that apply to nonblind individuals also apply to these persons. Use the monetary guides in DI 10501.015 and the evaluation guides in DI 41001.010 and DI 41001.015 for assessing SGA.

B. Processing a continuance

1. SSA-833-U5 determination

The instructions in DI 41005.001 apply. Also see the next paragraph. DI 41005.035, Exhibit 11 contains an example of the completed form SSA-833-U5.

In item 9 of the SSA-833-U5, check “disability” and blocks 9A, 9J and 9J(1). Check and complete item 9D if appropriate (see DI 41005.001J.4.).

2. Notice

See NL 00701.425 for the proper completion of the SSA-L1013 notice.

3. Rationale

The technical rationale should be prepared on an SSA-4268-U4. See DI 41005.005.

C. Processing a cessation

1. SSA-833-U5 determination

This will be prepared in the usual manner per DI 13010.170 and DI 41005.035 and the instructions below.

a. Individual entitled to a TWP

In item 9 of the SSA-833-U5, check “disability.” Complete blocks 9B though 9H as appropriate (see DI 41005.001J.3. for completion of block 9C if an entry is needed there.) Also check block 9J and 9J(1). See DI 41005.035, Exhibit 2 for an example of the completed form.

b. Individual not entitled to a TWP

In item 9 of the SSA-833-U5, check “disability.” Complete blocks 9J, 9J(1) and 9J(1)(b). Enter the first month and year of SGA in block 9J(1)(b). Complete item 9C as shown in DI 41005.001J.3. and show the second month (plus year) after the month shown in block 9J(1)(b). See DI 41005.035, Exhibit 13 for an example of the completed Form SSA-833-U5.

2. Notice guidelines

  1. a. 

    If EPE is involved, use the exhibits in DI 13095.140.

  2. b. 

    If the EPE is involved but ended and benefits will terminate at the time the SSA-833-U5 is prepared, include the following sentence in the notice: "Your disability freeze will continue until you reach full retirement age or you no longer meet the definition of blindness contained in the law."

  3. c. 

    If the EPE is not involved use T21 and include the following sentence: "Your disability freeze will continue until you reach full retirement age or you no longer meet the definition of blindness contained in the law."

  4. d. 

    Prepare a personalized explanation of the decision on an SSA-4268-U4 (see NL 00601.010B.2.) and ask the typist to attach it to the notice to the beneficiary.

3. Rationale

The technical rationale should be prepared on a separate SSA-4268-U4. See DI 41005.005.
