DI 42586.006 Acknowledgements -- Stieberger

A. Policy

  1. 1. 

    CO provides every responder with a written acknowledgement (DI 42586.095, Exhibit 3) that a request for reopening was received.

  2. 2. 

    The acknowledgement states “ Stieberger Acknowledgement” with the name, address, and SSN of the responder and the date of the request for reopening.

  3. 3. 

    CO makes every effort to provide written acknowledgement within 30 days of the receipt of the request.

  4. 4. 

    CO provides acknowledgements for all responders including those responding in person to the FO or OHA.

Where the individual responds by letter, telephone, or in person to the FO or OHA, the FO or OHA office will immediately provide written and dated confirmation that the request for reopening was received (see DI 42586.005, item 6.).

B. Procedure

1. Association

Upon receipt of the CATS alert, ODIO will:

  1. a. 

    Associate the alert with the response form and related queries (Supplemental Security Income Record Display (SSIRD), AR-25, FACT, ODIO Overnight, OHAQ, and SEQY) and place all material in a green Stieberger Jacket (see 2., below).

    NOTE: If the SSI case control system (SSICCS) shows “Not in File” (NIF), an AR-25 will not be generated. NIF will be shown in the Folder Location Information Field on the CATS alert instead.

  2. b. 

    If the response form cannot be located, annotate the alert “UTL Response Form” .

  3. c. 

    If a responder has a civil action case pending prescreening processing will be per GN 03106.090 and the Stieberger screening instructions (see Exhibit 4, DI 42586.095).

2. Green responder jacket

  1. a. 

    Prepare a special green jacket to route the alert, queries, and response form and any other material to the FO for processing.

  2. b. 

    Label the green jacket “ STIEBERGER COURT CASE.”

3. Alerts

Examine the alert. Late responders are identified by the remark “LATE FILING-GOOD CAUSE DEVELOPMENT NECESSARY.” Screen for entitlement to review per DI 42586.008.

4. Non-entitlement to reopening

If the responder was screened out (DI 42586.008), send the Notice of Non-Entitlement to Reopening (Exhibit 5, DI 42586.095).

5. Claims folders

If the query package indicates a subsequent disability allowance, obtain the folder and forward to the FO when releasing the responder jacket (DI 42586.010B.).

6. Timely responders

  1. a. 

    Place the CATS alert, response form, all queries and other material (if any) in the responder jacket.

  2. b. 

    Route the responder jacket to the servicing FO via an SSA-559 for an interview to update the file with sources of medical and nonmedical information.

7. Late responders

  1. a. 

    Place the alert, response form and all queries in the responder jacket.

  2. b. 

    Route the responder jacket to the servicing FO via an SSA-559 for development of good cause for late reply per GN 03101.020. Instruct the FO to return the material to ODIO/PSC for the good cause determination.

8. CATS update

Scan the bar code on the alert to update CATS to show the FO destination. Be alert to any change in the address on the response form which will change the current servicing FO.
