DI 43525.035 Failure to Cooperate-CDR

NOTE: See DI 43510.080

When continuing disability review is necessary and the individual does not furnish information about work activity or medical treatment, or otherwise fails to cooperate with efforts of the foreign service posts (FSP), assume that the individual is unable rather than unwilling to cooperate. (The failure to cooperate may be a result of the impairment.) If the disabled beneficiary fails to comply with a written request for information, the FSP should follow the same procedures as the DO. (See DI 13005.000 for DO instructions.) The FSP must fully document all efforts to have the individual cooperate because benefits may be terminated due to lack of cooperation.
