Use the maximum weekly WC rates to:
-
•
impose offset when the actual WC rate is unknown and the claimant has not provided
any proof ; or
-
•
prorate a lump sum (LS) when a periodic rate is not specified in the LS award and
no periodic WC payments were paid prior to the LS.
The maximum WC rates can be exceeded. For example, if a claimant is awarded LS amounts
for different injuries, each settlement is prorated separately, the amounts for concurrent
periods are added together and the total amount of WC for offset purposes exceeds
the State maximum.
If number holder (NH) alleges a rate higher than the weekly maximum rate in the charts,
use the alleged rate for your computations.
