SI 01320.120 Deeming - Foster Care Payments for an Ineligible Child - Policy Principle

Authority: Regulations 20 CFR 416.1161 (a)(5), (b), (c), (d)

Any payments received for providing foster care to an ineligible child do not represent income for deeming purposes, nor do the payments represent income to an ineligible child for purposes of determining the allocation. Any foster care payments received by an essential person or a sponsor of an alien are subject to deeming.
