SI 01320.125 Deeming Value of Supplemental Nutrition Assistance Program (SNAP) and Department of Agriculture Donated Foods

CITATIONS:

20 CFR 416.1161(a)(6) , (b) , (c) , (d)

Do not consider the value of assistance as income, in the deeming computation for an individual, who received assistance from another person, or directly from the Supplemental Nutrition Assistance Program (SNAP).

In addition, if the Department of Agriculture (e.g., supplemental food programs) donates food to an individual, for deeming purposes, do not consider the value of that food as income.

This exclusion applies to the income of

  • a spouse,

  • parent(s),

  • an essential person,

    (For Essential Person definition, see SI 00501.100)

  • the sponsor of an alien, and

  • an ineligible child living in the household

For purposes of determining the amount of the allocation, this exclusion also applies to the income of an eligible alien that an ineligible spouse or parent sponsored.
