SI SF01415.160 California Optional State Supplement (OSS) E – Disabled Child under Age 18 and G – Disabled Child under Age 18 Living in the Household of Another (effective February 1, 1982) (RTN 01, 05/2015)

A. OSS E - Disabled Child Under Age 18

1. General

California pays OSS E to a disabled (not blind) child under age 18 who resides with a parent or relative by blood or marriage (until September 30, 1979, a disabled child under age 18 living with a legal guardian also fell into this category).

NOTE: Effective February 1, 1982, only FLA A and C are compatible with OSS E. If the VTR applies, see OSS G SI SF01415.160B.

Examples:

  1. 1. 

    Maria Able, a 15 year-old disabled child, attends a residential school for the deaf and returns to Maria's parent's home on weekends, holidays and in the summer. Maria is determined to be residing in Maria's parent's household. Therefore, Maria's FLA is C and OSS E applies.

  2. 2. 

    Beatrice Charles, a 10 year-old disabled child, lives alone with a relative. Beatrice pays Beatrice's pro-rata share of the food and shelter expenses. Therefore, Beatrice's FLA is A and OSS E applies.

2. Development and Documentation

When an application is filed on behalf of a disabled child, the birth date of the disabled child must be documented in file. The status of "child' must be established whenever deeming, the VTR, the student earned income exclusion, the exclusion of one-third support received from an absent parent, and/or OSS E or G is applicable.

B. OSS G - Disabled Child Under Age 18 Living in the Household of Another - Effective February 1, 1982

California pays OSS G to a disabled (not blind) child under age 18, who resides with a parent or relative by blood or marriage, and is determined to be subject to the VTR (SI 00835.200).

Examples:

  1. 1. 

    Terry Barr, a 3 year-old child, lives with grandparents in their mobile home. Terry's grandparents provide all Terry's food and shelter (Terry has no income or resources). Terry receives both food and shelter from grandparents and is determined to be subject to the VTR. Since Terry is under age 18, the OSS G rate is payable.

  2. 2. 

    Diana Meinhouse and Diana's parent live with friends. Neither Diana nor Diana's parent has rental liability or home ownership. They do not contribute to the household expenses. Diana’s living arrangement is FLA B/OSS G.
