SI 01730.015 Disability Determinations for Deceased Claimants to Establish Medicaid Eligibility

A. Policy

When a claimant dies without a spouse or parent eligible for an underpayment after filing an SSI disability or blindness application, a medical evaluation for initial claims and reconsideration by the Disability Determination Services (DDS) is still necessary when all of the following conditions are present:

  • The State has entered into an agreement for Federal determinations of Medicaid eligibility; and

  • There are unpaid medical expenses (UMEs); and

  • The State Medicaid agency requests the medical evaluation.

(See DI 11055.050 for disability instructions on processing these claims.)

When a State agency requests the medical evaluation cited in A. above, the DDS will return the case to the field office(FO) after a medical decision is made, and the FO will notify the State Medicaid agency of the determination in accordance with local notification procedures.
