HI 00815.042 Enrollee's Rights After Termination of Buy-In Coverage
Deemed Individual Enrollment Following Termination of State Enrollment
When an individual"s State enrollment ends, his SMI coverage period continues, beginning
with the month after his State enrollment ends, as though he had individually enrolled
in his IEP. Continuation of SMI also applies to an individual who was enrolled in
buy-in for a current closed period (see HI 00815.039C.1). However, if an individual was enrolled in buy-in for a retroactive closed period,
the current SMI status is not affected (see HI 00815.039C.2).
Termination of Individual Enrollment Following Termination of State Enrollment
If an individual"s State enrollment ends, he may terminate his deemed individual enrollment.
Effective April 1, 1981, any individual whose buy-in coverage has been terminated
and who files a notice requesting termination of his individual SMI during the last
month of buy-in coverage or during the 6 succeeding months will have his individual
SMI terminated at the end of the month in which his notice was filed.
In cases where the insured individual waits more than 6 months after buy-in ends to
request withdrawal, Part B coverage ends effective with the close of the calendar
quarter following the calendar quarter in which he notifies SSA or CMS that he wishes
to withdraw. If he is not receiving Social Security or Railroad Retirement benefits
and he does not pay the Part B premiums, Part B coverage ends at the end of the third
month after the month in which the premium bill is sent. See HI 00805.185 for procedures for terminating SMI enrollment following buy-in deletions.
Reenrollment After Termination Following Buy-In Coverage
A person whose individual coverage is terminated following a period of buy-in may
reenroll for Part B during any GEP.
