HI 01001.195 Beneficiary Reports Receipt of Government Pension After Entitlement to Spouse's Benefit
A. District Office Processing
When an individual reports to the DO receipt of a spouse's government pension after entitlement, request him/her to complete a Form SSA-3885 (Government Pension Questionnaire). If a government pension offset applies prepare a form SSA-795, (Statement of Applicant or Other Person), giving the first month and the amount the pension offset applies and forward to the appropriate reviewing office with the completed SSA-3885. Should the DO determine that a government pension offset does not apply, record this fact on the SSA-795 forwarded with the SSA-3885.
B. Reviewing Office Processing
If a report of receipt of spouse's government pension is received in the reviewing office, request the DO to have the beneficiary complete an SSA-3885 and to follow HI 01001.195A. Should government pension offset apply, use MADCAP paragraphs B68 or B69, whichever is applicable. If the case has been diaried, cancel the diary.
