HI 01140.011 Duplication of Appeal Requests

A. Policy for duplication of appeal requests

It is possible for a beneficiary to file a request for a hearing when an appeal is already pending. It is important to review the pending appeal as well as the new appeal request to determine if the appeal is for the same issue and the same premium year.

Anytime you receive an appeal request:

  1. 1. 

    Review the IRMAA Appeals Tracking System to determine if an appeal is pending.

  2. 2. 

    If an appeal is pending, review the Appeals Tracking System to determine if the new appeal request is for the same premium year as the pending appeal:

    1. a. 

      If the premium year is the same, see HI 01140.011B in this section. Follow the directions on how to process an appeal request when an appeal is already pending.

    2. b. 

      If there is no appeal pending or there is a different premium year involved, process the request as explained in HI 01140.010.

B. Processing an appeal request when an appeal is already pending

If ….

then…

the pending appeal is a reconsideration and the new appeal request:

  • is for the same premium year as the pending appeal, and

  • will change the current IRMAA determination;

  • Inform the beneficiary you are sending the new appeal request to the office that currently has the appeal pending for the same premium year.

  • Use a route slip stating “New/Duplicate Appeal Same PY received. Associate with reconsideration filed mm/dd/yy.”

  • Send an e-mail to the Office Mailbox of the office with the pending appeal and advise the office that new and material evidence has been received and was mailed mm/dd/yy. The email should also contain the name and SSN of the beneficiary.

the pending appeal is a hearing request and the new appeal request:

  • is for the same premium year as the pending appeal, and

  • will change the IRMAA determination.

  • Do not process the appeal request.

  • Send an MDW to FO C34.

  • Show the ISSUE as “IRMAA HEAR”.

  • Complete the REMARKS with a statement that a new hearing request has been received with information that will change the IRMAA determination. Document that the appeal request is being sent to SEPSC and an appeal is already pending with OMHA.

  • Send the appeal request to:
