We have considered your application for spouse’s benefits on (1) 's Social Security record. You are not entitled to benefits now because you do not meet the marriage requirement.

           

Why We Can Not Pay You

You can not get benefits because your marriage does not meet the requirements of the law. You can only qualify for benefits as a spouse if one of the following is true:

 

  • Your marriage to (2) is valid under State or Federal law, or

 

  • Your marriage to (3) is not valid, but you went through a marriage ceremony in good faith.

OR

 

3901B(2 MAR032)

You can not get benefits because your marriage does not meet the requirements of the law. You can only qualify for benefits as a spouse if one of the following is true:

 

  • Your marriage to (4) is valid under the law of the State or country of residence, or

 

  • Your marriage to (5) is not valid, but you went through a marriage ceremony in good faith.

OR 

3901F(3 MAR033)

You can not get benefits because your marriage does not meet the requirements under Federal law for payment of Social Security (6) benefits.

Other Social Security Benefits

You are not entitled to any other Social Security benefit based on the application you filed. In the future, if you think you may be entitled to benefits, you will need to apply again.

  • Send this notice when a spouse does not meet marriage eligibility requirements for entitlement. Use paragraph 3901B for foreign claims; otherwise use paragraph 3901A.

  • Use 3901F (or MAR033) when the disallowance is due to a same-sex marriage. For text and fill-ins see NL 00703.905.

  • For 3901C and 3901D text and fill-ins refer to NL 00703.005E. Use 3901E, 3900B and 3900A in all cases.

  • For 3900B and 3900A text refer to NL 00703.900 and for 3100E text. Refer to NL 00703.100.

C. Typing instructions for Preparing the Notice

Use Form SSA-L2000-C2 (Universal Notice). Refer to Form SSA-3428-U2 (Determination of Disallowance Coding Sheet) “Name and Address Information” field in block 2 for completing the name and address. Because the fill-ins may vary according to the different situations, follow the requester's typing instructions carefully.
