NL 00750.002 Guide To Notice Language

A. BACKGROUND

Most general information about “working while disabled” is included in the SSA pamphlet enclosed in all disability award notices, SSA Publication No 05-10153 and should not be duplicated in the body of the award notice.

Listed below are common “working while disabled” scenarios:

    SOME TWP MONTHS—FUTURE TWP EXPIRATION (CURRENT WORK)

  3. 3. 

    TWP EXPIRED, BUT WORK STOPPED OR ONGOING WORK NOT SGA

  4. 4. 

    TWP EXPIRED, DIB CESSATION WITH S7 SUSPENSION (EPE NOT OVER)

  5. 5. 

    TWP EXPIRED, DIB CESSATION WITH S7 SUSPENSION & T8 EPE TERMINATION

  6. 6. 

    TWP EXPIRED, DISABILITY CESSATION WITH REINSTATEMENT MONTHS

  7. 7. 

    SGA CESSATION WITH NO TWP OR TWP-NO EPE CASES

  8. 8. 

    CASES INVOLVING IRWES

The scenarios may not fit every situation; however, adjudicators can select AURORA paragraphs, or use AURORA paragraphs in connection with any other MADCAP or EC paragraphs to fit their particular situation. Some paragraphs may not have been updated with the current self-employment TWP hours; therefore, in self-employment cases, use MADCAP dictated language paragraphs M30 or M31 to furnish current information about self-employment activity.

B. EXAMPLE - TWP EXPIRED, DIB CESSATION WITH S7 SUSPENSION (EPE NOT OVER)

If the situation is a TWP Expired, Dib Cessation With S7 Suspension (EPE Not Over); put an I*, plus any MADCAP paragraphs in the NOTICE block of the A101 BCRN screen.

On the RPOC/DW03 screen, code the AURORA paragraphs as follows:

  • SGA 702.10 (February 2002)(January 1998 through August 1998, and February 2002)

  • TWP204 (Your)(your)(your)(your)(March 2002)(May 2002)(You)(get)(36)(your)(your)

  • PCINF1000 (considered)(your)(We used your pay stubs, the earnings recorded to your Social Security earnings record, and the Work Activity Report form SSA 821-BK you signed on July 2, 2003.)

  • TER205 (You)(are)(June 2002)(you)(were)

  • PCDIB2011 (36)

 

C. POLICY

Existing MADCAP (A101 cases) or EC (EC cases) paragraphs should be used FIRST. Use AURORA only when no existing MADCAP or EC paragraph fits the notice situation. If sufficient information cannot be provided by using existing MADCAP or EC paragraphs, the notice should be designated as INCOMPLETE and AURORA paragraphs used. If additional dictated language is needed, use MADCAP “dictated language” paragraph M30 on incomplete notices and M31 on complete notices.
