NL 00756.100 No Social Security Benefits for Prisoners (NSSBP) Title II Paragraphs

A. Holding past due monthly benefits subject to the NSSBP

Use these paragraphs in initial claim (IC) and post-entitlement (PE) notices to inform the beneficiary we are holding past due monthly benefits subject to the NSSBP provision. For information on the NSSBP provision, see GN 02612.001.

1. Prisoner paragraph

Include the following paragraph in the notice informing the beneficiary that we are holding past due monthly benefits because they are subject to current prisoner monthly suspension provisions according to GN 02612.001B.1.

We cannot pay back benefits to people who are:

  • convicted of a crime and imprisoned for more than 30 days, or

  • confined for more than 30 days to an institution at public expense because of a court order.

2. Fugitive felon (FF) and probation and parole violation (PPV) paragraph

Include the following paragraph in the notice informing the beneficiary that we are holding past due monthly benefits because they are subject to current FF or PPV monthly suspension provisions as defined in GN 02612.001B.2. and GN 02612.001B.3.

  • fleeing to avoid prosecution, custody, or confinement for a crime that is punishable by death or a prison term of over 1 year, or

  • violating probation or parole under Federal or State law.

Please contact us when (_*F3_) (_ *F4_) the arrest warrant or (_ *F5_) probation or parole violation ends. We may be able to pay the back benefits then.

3. Generating prisoner, FF, or PPV paragraphs

If the system cannot generate an automated notice with the appropriate prisoner, FF, or PPV paragraph, code the appropriate universal text identifier (UTI) paragraph in the manual notice.

a. Automated notices

T2R includes these paragraphs in a notice if a transaction creates past due monthly benefits and there is an open prisoner issue in the PRSNDATA line or an open FF or PPV issue in the FUGITIVE line of the MBR.

b. Field office (FO) action

Code the appropriate UTI paragraph in the A101 or EF101 when adjudicating an initial claim (IC) award to prisoner or FF suspension, and past due monthly benefits are due. The UTI paragraphs are located in NL 00756.100A.1. and NL 00756.100A.2. in this section. Coding the UTI in the A101 or EF101 alerts the PC to include the paragraph in the manual award notice.

c. Processing Center (PC) action

When processing an A101 or EF 101 to prisoner or FF suspension, and past due monthly benefits are due, include the appropriate UTI paragraph in the manual award notice located in NL 00756.100A.1. and NL 00756.100A.2. in this section. Include the paragraph even if the FO did not code the UTI paragraph in the A101 or EF101.

If a post entitlement (PE) transaction creates past due monthly benefits and there is an open prisoner, FF, or PPV issue on the master beneficiary record (MBR), include the appropriate UTI paragraph in the manual notice located in NL 00756.100A.1. and NL 00756.100A.2. in this section. To determine if there is an open issue on the MBR, see instructions in GN 02612.001C.

B. Paying past due monthly benefits no longer subject to the NSSBP

Use this paragraph in PE notices to inform the beneficiary we are no longer holding past due monthly benefits.

1. Payment of past due monthly benefits paragraph

Include the following paragraph in a notice informing the beneficiary that we can pay past due monthly benefits because they are no longer subject to current prisoner, FF, or PPV monthly suspension provisions.

T2R includes this paragraph in a notice when a transaction ends the open prisoner issue in the PRSNDATA line or an open FF or PPV issue in the FUGITIVE line and there are past due monthly benefits in the SPA line on the MBR.

b. PC action

Include this UTI paragraph in the manual notice when past due monthly benefits are in the SPA line on the MBR, and we are ending the open prisoner issue in the PRSNDATA line, or the open FF or PPV issue in the FUGITIVE line on the MBR.
