GN 00502.301 State and Territory Digest of Crimes Barring an Individual from Serving as Payee

A. Background of the state and territory digest of barred crimes

Using information provided by the Office of General Counsel (OGC), we have compiled a digest of State and United States territory criminal law terminology to assist with determining if an individual is barred from serving as a representative payee per the policy in GN 00502.133A.4.

B. Procedure for using the state and territory digest of barred crimes

The digest will assist you with determining if an individual is barred from serving as a representative payee based on the State or territory where the crime was committed. If you are unsure whether the crime is a barred crime (i.e., the crime can be a felony or a misdemeanor) or you need further information about verifying criminal history on payee applicants, see GN 00502.117B.3.

Per the policy in GN 00502.133A.4., in order for an individual to be barred from serving as a payee, the conviction must be a felony. Some States and territories charge a particular crime as either a felony or a misdemeanor depending on the circumstances. The digest clearly identifies specific crimes that can be a felony or a misdemeanor.

The numerical code after the name of the crime is the State or Territory criminal statute code; for example, Trafficking in persons: 53a-192a. You may see this code on the Background Check Results screen (MS 07409.024) in the Electronic Representative Payee System (eRPS) or on court documentation. If there is a code in the eRPS or on court documentation, verify that it is the same as the code in the digest. If there is no code in the eRPS or on court documentation, verify that the name of the crime is the same as that in the digest.
