DI 27010.015 Deficiency Return on Effectuated Reconsideration

A. ALJ hearing requested

Process case as promptly as possible as an informal remand according to the instructions in DI 81020.119—Processing Electronic Informal Remands for certified electronic folders (CEF) or DI 27520.001—Informal Remand (IR) Cases to the Disability Determination Services (DDS) for modular disability folders (MDF) and:

  • Notify the reviewing component by annotating a copy of the SSA-1774 (deficiency transmittal) to show that an ALJ hearing request was filed.

  • Route the case according to the instructions in DI 27520.005—Disability Determination Services (DDS) Action upon Receipt of Informal Remand (IR) Cases.

B. If claimant contact necessary

Do not mention the possibility of revising the determination or possible overpayments. Tell the claimant:

  • His or her case has been selected for review by the Social Security Administration;

  • What additional information is needed; and

  • He or she will be notified of the final result of the review.

C. No formal reopening

If the claimant is aware of additional development and new evidence does not result in a formal reopening:

  • Prepare a notice to advise the claimant according to the instructions in NL 00705.256—Reopening 12 – No Change in Basis of End Result- Claimant Aware or Denial of Request to Reopen and Revise – Title II or Title XVI; and

  • Place the notice in the file for release by the review component.
