GN 02250.010 Undocumented Allegations - Waiver - Title II, XVIII

A. Policy

If a person makes allegations for which documentary evidence does not exist, it is necessary to determine the credibility of the person's statement before accepting the allegation.

B. Procedure

1. Determine Whether Documentation Exists

Before accepting any allegation, check all available records. Use OPTEL or an administrative message to request the PC to check the folder for any reports or output reflecting alleged reports. The PC should call the FO to determine if the FO has any record of the alleged report being made.

2. Obtain Detailed Statement About the Allegation

If a person alleges filing a report which is not in our files, obtain a statement which includes at least the following information:

  1. a. 

    how the report was made;

  2. b. 

    to whom the report was made;

  3. c. 

    the exact contents of the report;

  4. d. 

    what the person expected would happen as a result of the report (e.g., benefits would terminate, person would be notified only if benefits affected, etc.); and

  5. e. 

    why the person did not recontact SSA when no action was taken on the report.

3. Evaluation

Evaluate the person's allegations in light of the facts of the case. If the facts and the allegations are not inconsistent, resolve the question in favor of the person. Whether the allegation should be accepted is different from whether the person is without fault.
