Assumptions can generally be made about some commonly occurring overpayment situations as discussed in GN 02250.020-GN 02250.072. Use these sections as guidelines for evaluating without fault allegations. Patterns similar to those described are not sufficient to justify a finding of fault/without fault if the facts warrant a different conclusion. If without fault is found for the number holder under one of these sections consider without fault on the same basis for auxiliaries regardless of whether they are in the same household.
