RS 00615.738 Maximum Family Benefits with a DIB Guarantee PIA in January 1996 or Later

A. POLICY

If the DIB Guarantee PIA is selected as the payment PIA and the reentitlement or the NH's death is in 1/96 or later, a family maximum that corresponds to the DIB Guarantee PIA is used.

For DIB reentitlement, the family maximum equals the maximum in effect in the last month of the previous DIB entitlement, plus the same COL increase, if any, that applies to the DIB Guarantee PIA.

For RSI cases, if the prior maximum was determined under the 1980 Disability Maximum method, the corresponding RSI formula maximum for the PIA in effect in the last month of disability entitlement must be determined, using the procedure in B. The same COL increase, if any, that applies to the DIB Guarantee PIA is added to the RSI formula maximum in effect in the last month of DIB.

If the new entitlement or the NH's death is prior to 1/96, follow the instructions in RS 00615.736.

NOTE: Existing type of maximum codes (C, D, S or T) apply.

B. PROCEDURE

To compute the corresponding RSI formula maximum, deconvert the DIB Guarantee PIA to the raw PIA by removing all COL increases.

NOTE: The raw PIA must be based on the AIME most recently determined after all recomputations. Apply the corresponding RSI bendpoint formula for the eligibility year of the raw PIA. Convert the raw RSI formula maximum to the last DIB entitlement month by adding all COL increases from the eligibility year through the last month of prior DIB entitlement. (The result is the corresponding RSI formula maximum in the last DIB entitlement month).

C. EXAMPLE

Bob became entitled to DIB in 1985 with an onset date of 3/16/85; the maximum is based on the Disability Maximum method. In 10/96, they die and the DIB Guarantee PIA is the largest PIA for the survivors. The DIB PIA in 9/96 is deconverted to the raw PIA for 1/85. Since Bob had two recomputations for 1988 and 1992 earnings, the most recent 1/85 “raw” PIA is based on the AIME after the 1992 recomputation.

The 1985 FMAX formula is applied to the raw PIA and COL increases from 1985 through 9/96 are added. In 10/96 the survivors' benefits are determined using the DIB Guarantee PIA and the corresponding RSI formula maximum.
