The 1980 amendments introduced a special limit applicable in determining the total amount of the family maximum benefit payable in disability claims effective July 1980 or later.
The DMAX applies to all disability claims
When the eligibility year is after 1978, and
The initial entitlement to DIB begins after June 1980, and
The PIA is an AIME, OS, Special Minimum or Frozen Minimum PIA.
The DMAX does not apply if
The NH was ever entitled to DIB before July 1980, or
The eligibility year is before 1979, or
The NH attains age 62 before 1979.
