RS 00615.742 Maximum Family Benefits Based on DIB Eligibility After 1978 — Initial Entitlement After June 1980

POLICY

1. Computing the Disability Maximum (DMAX)

The DMAX is the smaller of:

  • 85% of the AIME (but not less than the PIA before COL increases), or

  • 150% of the worker's PIA before COL increases.

NOTE: After the initial disability family maximum is computed, all intervening COLAs must be added to determine the actual maximum payable in the month of entitlement and subsequent maximums.

2. Effects of DMAX

  • The DMAX applies as long as the DIB entitlement continues.

  • The DMAX will be converted to an AIME maximum when the DIB is changed to RIB or the NH dies.

  • Reduced auxiliary benefits are based on benefits derived from the DMAX.

  • The possibility of electing reduced RIB must be explored at the time of filing for RIB when there is simultaneous entitlement to DIB to determine if total family benefits will be greater by electing reduced RIB. See RS 00615.110.
