RS 01602.215 Railroad Retirement Board (RRB) Reverses Jurisdiction Determination

A. Field Office (FO) action when the RRB reverses jurisdiction determination

This section provides instructions for FO action if the RRB reverses a jurisdiction determination.

  WHEN…

THEN…

RRB reverses a jurisdiction determination on a survivor claim transferred to RRB by FO.

RRB notifies claimant that SSA has jurisdiction of the claim.

 

RRB returns all claims material to the FO, indicating RRB does not have jurisdiction, and

 

RRB includes a copy of the notice sent to the claimant.

FO Action when RRB returns a claim as FO jurisdiction.

Secure an Informational/Certified Earnings Record (ICER), and

 

Process the claim. Apply critical case procedures, if applicable, considering instructions in RS 02803.001.

B. Processing Center (PC) action when RRB reverses jurisdiction determination

This section provides instructions for PC action if the RRB reverses a jurisdiction determination.

THEN…

RRB reverses its jurisdiction determination of a survivor claim transferred to RRB by a PC.

RRB notifies claimant that SSA has jurisdiction of the claim.

 

RRB sends form G-37E to the PC, and returns the claims material, indicating RRB does not have jurisdiction, and

 

RRB provides a copy of the notice sent to claimant. See RS 01602.630E in this section for a copy of a G-37E.

PC action when it receives the claims material from RRB.

Complete any required development.

Request an ICER, if needed, and process the claim.
