DI 13005.090 Basis for Deciding Disability Issues Subsequent to Suspension or Termination of Supplemental Security Income (SSI) Benefits

As noted in DI 13005.005, the basis for deciding continuing disability is not the same as the basis for deciding the issue of disability in an initial claim.

If an SSI recipient is ineligible:

  • for any SSI benefit for 12 consecutive months, or

  • if the recipient is found (under the medical improvement review standard (MIRS)) to no longer have a disabling impairment, the disability standards applicable to initial claims in DI 10105.065 apply to any subsequent disability decision (for example, claimant files to re-establish eligibility).
